Canada's Anti Spam Legislation- City of Guelph compliance measures

To protect Canadians from spam, the Canadian government passed its new anti-spam law in December 2010. This Act takes effect on July 1, 2014.

I’m pleased to inform all that the City has taken steps and is in compliance with this legislation.

Canada’s anti-spam legislation (CASL) and its regulations apply to various forms of commercial electronic messages (CEM) sent by the City. This includes messages to email addresses and social networking accounts, and text messages sent to a mobile device. Examples in include messages about recreational programs, special events, advertising, and general information, all of which is considered spam under the legislation.

To ensure compliance across the corporation, the City formed a working group to learn more about the Act, understand how it applies to the corporation, and to identify which departments and/or employees are sending CEM to the public.

Information Technology has worked with internal client areas to develop processes and systems so employees can document when and how obtained consent or non-consent was given. Internal processes have also been developed to give external clients the opportunity to subscribe to and unsubscribe from receiving electronic messages from the City.
Further, the working group has developed a corporate compliance program that includes: risk assessment, policy, record keeping, training, auditing and monitoring, and a complaint-handling system.
