Clubhouse Donuts Closes

As a result of calls from the media, staff have been made aware that Clubhouse Donuts at the corner of Speedvale Ave. E. and Victoria Road, have made statements to the media to the effect that the City has closed their business down. They have also posted signs to this effect outside the business.

This particular business has been charged 18 times under the City’s No Smoking By-law, and convicted seventeen times. The charges date back to 2003. In addition, charges under the Smoke-Free Ontario Act have also been laid and are pending before the Court. It is my understanding that none of the fines imposed by the court have been paid to date.

In light of the history of non-compliance, the Acting Medical Officer of Health had written to the City asking that the business licence not be renewed for 2007. Notice was sent to the business of the City’s intent to not renew the licence, and the owner appealed. A hearing by the Business Licence Appeals Committee had also been scheduled to hear the owner’s appeal of our intent to not renew the 2007 licence, but was tentatively adjourned when the City was informed in writing by the owner’s agent that they would be closing as of the end of May. This same information was also conveyed during a court hearing on March 28, 2007 on a breach of probation charge relating to the Smoking By-law (on which the owner was also convicted), when the owner’s representative informed the court that the business would be closing at the end of May.                      Staff
